Mediation Musings: Settling Disputes Outside Courts – The Win-Win Way
No society if perfect. Conflicts are common to the society. However the maturity of the society depends on how these conflicts are addressed. Advanced societies bring consensus among different groups by mutual consent. Societies and families lost long when they use consensus rather than conflict model in redressing the differences.
Mediation and negotiation helps the societies, families, organizations and individuals in building relationships by controlling conflict process of naming, blaming, and claiming. Mediation plays very important role particularly when the disputants poses intense emotions and breakdown of communication mechanism. Mediation provides a platform where disputants are perceived as a problem solver than opponents and creates an atmosphere where the disputants could refocus on their interests rather than their positions thereby paving a way to have an amicable settlement. Mediation enhances the self-determination. In mediation you are not at the mercy of a third person for a settlement which would impact your life.

Therefore, V.M.Salgaocar College of Law in association with ICG and WMO, Berlin provides such an opportunity to the audience in understanding how to settle the disputes without going to the court. The talk aims at sensitizing the people that settling differences not necessarily always result in win loss. Our endeavor is that law schools, law faculty, law students and the lawyers must bring peace in the community.

All should attend; as we all of us involved in conflict resolution somehow in the family relation, commercial transaction, social relations or legal disputes.
